Book "Green Constitutionalism Against Climate Change" Published
The link between climate change and law is generally stronger than is commonly thought. It can even be readily argued that global warming stems from modernism's human-nature dualism and humanism's idea of human supremacy. The capitalist economic order established by the bourgeoisie, which rose on these philosophical foundations, and the modern state structure that emerged as its protector form the roots of our existential problem today. Therefore, it is not possible to resolve the climate crisis we face today without questioning and limiting the current economic, political, and legal order. To do this, and to bring our societies back into harmony with nature's network-based structure within the short time scientists say remains, we must use the idea of constitutionalism. Just as the bourgeoisie once used natural law theory and the principle of the rule of law to limit the absolute power of kings, today we must limit the bourgeoisie, which has de facto abolished the separation of powers and established a hegemony, within the framework of climate justice, through green principles and by means of high courts. In addition to offering an idea of why green constitutionalism is necessary and how it can be put into practice, this book also examines the decisions handed down by high courts in climate cases filed around the world to date.
